JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 112 of 2018, arising out of Kankarbagh P.S.Case No. 893 of 2018, registered for the offences punishable under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act.

Allegation is of recovery of 3.950 kg. of ganja from the hut and it is stated that petitioner and others fled away from the place of occurrence.

Submission of learned counsel for the petitioner is that nothing is available on the record to show that the hut belongs to the petitioner and petitioner is accused in two other cases in which he is on bail.

Heard learned APP also.

Patna High Court CR. MISC. No.22290 of 2019(2) dt.08-04-2019 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
