2. Petitioner apprehends arrest in a case registered for the offence punishable under section 274, 275 , 3(5) and Section 30 (a) of Bihar Prohibition and Excise Act. 3 . It is alleged that 288 lieter Nepali country made liquor was recovered by the side of Dam.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion . Recovery has been made from an open place which is accessible to one and all. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner

5 . Learned counsel for the State opposes the bail petition .

Considering the fact that recovery has been made from an open place , clean antecedent and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned special Judge Excie Act Jhanjharpur Madhubani in connection with Jhanjharpur Police Station Case No. 05 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
