The petitioner seeks bail in Rail P.S. Case No. 238/2018, instituted for offence under Section(s) 20 and 22 of NDPS Act.

Learned counsel for the petitioner has submitted that petitioner is lady. She is in custody since 02.12.2018. She has clean antecedent.

It is alleged in the written report that three ladies including this petitioner were arrested by the police at platform no. 3 and 4 under suspicious condition. On search of those ladies Ganja was recovered. It is alleged that 16.900kg Ganja was recovered from possession of co-accused Rekha Devi and

Patna High Court CR. MISC. No.19916 of 2019(4) dt.23-07-2019 2/3 15.300kg Ganja was recovered from possession of co-accused Ram Samindra Devi. From possession of this petitioner, 21.800kg Ganja like substance and cash of Rs. 6900/- was recovered. It is further alleged that from possession of coaccused Madhu Kumari 7.700kg Ganja was recovered. The other co-accused, namely, Rekha Devi and Ram Samindra Devi have already been granted bail by different Benches of this Court vide orders dated 07.03.2019 passed in Cr. Misc. No. 13460/2019 and dated 29.03.2019 passed in Cr. Misc. No. 17422/2019.

By order dated 01.05.2019 forensic report was called for, but the same has not been received. Case diary has been received.

Report from the court below (kept at flag 'A') has been received, wherein it is mentioned that forensic report has not been submitted till date.

Considering the fact that petitioner is lady having clean antecedent and she is in custody since 02.12.2018, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-
