The petitioners seek regular bail in connection with Kaluahi P.S. Case No. 203 of 2022 registered for the offence under Sections 328, 302/34 of the Indian Penal Code. As per FIR, the accused persons used to torture daughter of informant mentally and physically. Thereafter, the informant came to know that her daughter has been committed murder after administering her poison by the accused persons including the petitioners.

Learned counsel for the petitioners submits that the

The petitioners are in-laws of the deceased due to which they have falsely been implicated in this case. The petitioners have no concern mess and business of the deceased or with her husband rather they were living separately from them. Learned counsel for the petitioners further submits that the husband of the deceased was already in custody. It is further submitted that the petitioners are languishing in judicial custody since 13.11.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Kaluahi P.S. Case No. 203 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Madhubani.
