JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report nor anything appears to have been recovered from his conscious possession. The name of petitioner came in this case when he was arrested in connection with another case and confessed his guilt disclosing his involvement in this case. After confessional statement of the petitioner in connection with another case, he has been made accused in this case.

No doubt, petitioner does have criminal antecedent of seven cases but in the present case, except suspicion, there is nothing against him.

Patna High Court Cr.Misc. No.38878 of 2016 (3) dt.17-11-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Siwan in connection with Guthani P.S.Case No. 138 of 2015.
