====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 03-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chousa P.S. Case No. 153 of 2014 instituted for the offence under Sections 302 and 120B/34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. During investigation, the name of petitioner has come in the statement of Md. Etabul made in paragraph-22 of the case diary wherein he has stated that on the alleged date of occurrence petitioner along with co-accused Arvind Singh was seen at the gate of deceased. Besides this suspicion, there is no allegation against the petitioner. Counsel for the petitioner further submits that petitioner and deceased used to have talk in Grahak Seva Kendra, run by the petitioner.

Patna High Court Cr.Misc. No.70336 of 2018(2) dt.03-12-2018 2/2 Petitioner is said to be in custody since 20.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Uda-Kishunganj, Distt. Madhepura, in connection with Chousa P.S. Case No. 153 of 2014, subject to the condition that both the bailors will be the close relatives of the petitioner.
