JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 379/411 of the Indian Penal Code, Section 21 of MMDR Act, Section 56 of Bihar Minerals Rules and Section 15 of Environment Protection Act. As per the prosecution case, one tractor trolley loaded with sand was seized.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. Petitioner is neither driver nor owner of the vehicle in question. Petitioner has got no concern with the seized sand or tractor trolley.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.
