1. For quashing letter no.43 dated 07.01.2021 issued by the Additional Assistant Engineer, Electric Supply Sub-Division, Darbhanga as well as letter issued on 21.01.2021 by the Additional Assistant Engineer, Electric Supply Sub-Division, Darbhanga, whereby and wherein the petitioner was directed to deposit Rs.4,78, 298/- within 15

Patna High Court CWJC No.9841 of 2021(2) dt.03-01-2022 2/3 days, failing which, the authorities will file FIR against the petitioner so that motivated desire of the Additional Assistant Engineer, Electric Supply Sub-Divisioin, Rural Darbhanga be reached but the respondent Additional Assistant Engineer, Electric Supply Sub-Division, Darbhanga had already lodged FIR on 06.01.2021 before the officer-in-charge, Baheri police station, DistrictDarbhanga vide FIR no.07/2021, contrary to his instruction vide letter no.06 dated 21.01.2021 that the petitioner has to deposit Rs. 4,78,298/- within 15 days and also ignoring their own order, by which the petitioner was provided connection to run Lath Machine in his house.

(iii) And further be pleased to restrain the respondent authorities from any coercive action against the petitioner as apparently the entire exercise of the respondents to harass the petitioner and earn motivated desire under ill will consideration without providing any letter/order/information to the petitioner for disconnection of electric connection provided to run Lath Machine.

After the matter was heard for sometime, learned counsel for the petitioner seeks permission to withdraw this application reserving liberty to file appropriate petition in accordance with law on the same and subsequent cause of action.

Liberty is granted.

The present application stands dismissed as withdrawn.
