Petitioner, who is in custody, seeks bail in connection with Nalanda P.S. Case No. 85 of 2018 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Informant who is the mother of victim has alleged that her daughter Mony Kumari had left the house but thereafter she become traceless and after much search she could not be located. She had apprehension that unknown persons enticed her for marriage.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. The victim girl was recovered and his statement was recorded

Patna High Court Cr.Misc. No.68778 of 2018(2) dt.03-12-2018 2/2 under Section 164 of Cr.P.C. in which she has not alleged anything against petitioner, no role has been attributed in the whole episode against this petitioner. He has no criminal antecedent and he is in custody since 09.09.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 85 of 2018.
