2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Mithanpura P.S. Case No. 195 of 2023, lodged on 10.05.2023, under Sections 419/420 /467 /468 /471 / 120B of the Indian Penal Code.

3. As per the prosecution, the allegation against the present petitioners is that they have changed the Bar Code in

Patna High Court CR. MISC. No.22000 of 2025(2) dt.02-05-2025 2/3 answer sheets of intermediate Examination to make help to coaccused Nitesh Kumar, who has provided Bar Code to them.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that the real conspirator is Nitesh Kumar and he has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 09.04.2025 passed in Cr. Misc. No.69009 of 2024. Counsel further submits that antecedent of the petitioners are clean. He submits that they are employer only for ten days and under a conspiracy their names have figured in this case at the instance of the real culprit. Counsel further submits that they are ready to fulfill all the conditions whatsoever shall be imposed upon them.

5. Learned APP for the State vehemently opposes the prayer for bail of the petitioners and submits that it has specifically been alleged against the petitioners that it is the person who is responsible for changing the Bar Code and they are the real persons who have committed the offence.

6. In the present facts and circumstances that the person who has provided the Bar Code has been granted bail but the petitioners are the persons, who are responsible to change the Bar Code, this Court is not inclined the grant anticipatory
