The petitioner seeks bail in a case instituted under Sections 302/34/120B of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner along with other co-accused persons is said to have committed murder of the husband of the informant, while her husband was proceeding on his motorcycle for bringing vegetables and milk from the market. It is also alleged that the petitioner along with other co-accused persons were found roaming around the resident of informant. The informant believed that out of dispute for the homestead land, the accused persons had killed Mukund Kumar Singh, the husband of the informant.

Patna High Court Cr.Misc. No.37397 of 2016 (3) dt.27-10-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. On the basis of suspicion, the petitioner has been made accused in the present case. There is no substantive evidence to suggest his implication in the present case. The other co-accused have been granted anticipatory bail vide Cr. Misc. No. 50994 of 2013, Cr. Misc. No. 1376 of 2014 and Cr. Misc. No. 21626 of 2014 by another coordinate Benches of this Court. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 307 of 2013.
