The petitioner seeks bail in Sessions Trial No. 75 of 2019 arising out of Chhabilapur P.S. Case No. 67 of 2018, instituted for the offence under Section(s) 302/34 of the Indian Penal Code.

It is alleged in the written report that on 17.10.2018, husband of the informant had gone to market to purchase household articles and he did not return. In the morning she learnt from the villagers that dead body of her husband was thrown beside the road near Mahto Sangha village and his motorcycle was lying beside the dead body. It is further alleged in the written report that deceased had fallen in love with this petitioner and she in conspiracy with other accused as

Patna High Court CR. MISC. No.21907 of 2019(2) dt.30-05-2019 2/2 named in the written report has committed murder of the deceased.

Counsel for the petitioner submits that co-accused Manish Mistry has already been granted bail by this Court vide order dated 6.2.2019 passed in Cr. Misc. 6368 of 2019. Petitioner is in custody since 22.10.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd, Bihar Sharif, Nalanda, in connection with Sessions Trial No. 75 of 2019 arising out of Chhabilapur P.S. Case No. 67 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
