ANJANA MISHRA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 27.04.2016 in connection with Ramnagar P.S. Case No. 102 of 2016 registered for the offences punishable under Sections 394 and 307 of the Indian Penal Code and under Section 27 of the Arms Act. Learned counsel for the petitioner submits that he has been taken into custody on mere suspicion as he has owned a blue colour Passion motorcycle. It is further submitted that after having being taken into custody he has made a confessional statement which has no evidentiary value. He further submits that two other persons who are said to have been arrested on the basis of the confessional statement had since been released on regular

In view of the facts and circumstances and also because even though six months have elapsed but he has not been put on T.I. Parade, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub- Divisional Judicial Magistrate, West Champaran at Bagha in connection with Ramnagar P.S.
