JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 144, 427 of the Indian Penal Code, Section 3 of Explosive Substance Act, Section 3 of Prevention of Damage of Public Property Act and Section 17 of C.L.A. Act.

Petitioner is not named in the first information report but in course of investigation, one co-accused, Babu Ram Pal was arrested and confessed his guilt disclosing the involvement of the petitioner in the present crime and after that some witnesses claimed to have identified the petitioner. Petitioner is languishing in jail custody since 11.08.2016 and having more or less similar

Patna High Court Cr.Misc. No.43141 of 2016 (4) dt.13-01-2017 2/2 allegation, several co-accused have already been granted privilege of bail. Moreover, petitioner does not have any criminal antecedent, which is evident from perusal of para-3 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Deo P.S. Case No. 120 of 2009.
