The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

The informant alleged that his daughter was going to school and he saw his daughter talking with Tara Devi the petitioner near Sumerpur railway crossing, but his daughter did not return. The petitioner also could not be found. It is submitted that except suspicion there is no material. The police has investigated the case but did not collect any material against the petitioner. The witnesses disclosed that the victim had earlier also left her house and fled away somewhere else returned herself after sometime.

No.44043 of 2015 (3) dt.18-12-2015 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is a lady, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Prabhakar Jha, the learned Judicial Magistrate, 1st Class, Siwan in Mariwa P.S.
