JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 03-01-2022 The petitioner has prayed for the following reliefs : "(i) For the issuance of an appropriate writ to quash the order dated 24.06.2020 in Forest Revision Case No. 2 of 2020 passed by the Secretary, Forest and Environment Department, Govt. of Bihar (Respondent no. 2) (contained in Annexure 4) and direct Respondent no. 2 to decide the Revision in accordance with law.

(ii) For the issuance of an order directing the Respondent no. 2 to dispose the confiscation proceeding against the petitioner's Vehicle in accordance with law, following the directions issued by this Hon'ble Court time to time.

Patna High Court CWJC No.9971 of 2021(2) dt.03-01-2022 2/3 (iii) For the issuance of an appropriate writ/order/direction, directing the Respondent authorities or Respondent no. 4 to release provisionally the seized Vehicle bearing Registration no. BR24G/8536 in connection with Dehri Forest Case No. 43 of 2016 confiscated in confiscation case No. 106/2016 (D) during the pendency of the present writ petition or till the final disposal of Dehri Forest Case No. 43/2016 pending in the Court of the S.D.J.M., Dehri, Rohtas;

(iv) For the issuance of any other appropriate writ/direction/order/orders as your Lordships may deem fit and proper for the ends of justice or to allow the relief to petitioner for which he is found entitle."

After the matter was heard for some time, learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition reserving liberty to file a fresh petition, with better particulars, enclosing the entire material, including the proceedings of the authority below, if so required and desired.

Permission granted with liberty as prayed for. Liberty also reserved to the petitioner to make a mention for listing of the petition on priority basis. As and

Patna High Court CWJC No.9971 of 2021(2) dt.03-01-2022 3/3 when any such mention is made, Registry shall take steps for listing the petition at the earliest.

Instant petition stands dismissed as withdrawn in the aforesaid terms.
