JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Janta Bazar P.S. Case No. 12 of 2017 registered for the offences punishable under Sections 147, 148, 323, 379, 420, 467, 468, 471, 504, 34 of the Indian Penal Code.

Accused no. 1 Amrawati Kunwar executed sale deed in respect of a piece of land in favour of accused no. 2 and 3. The petitioner stood witness on the aforesaid sale deed. The informant claimed that the land in question was allotted to her father-in-law in partition and even knowing the aforesaid fact, the accused no. 1 transferred the said land by executing sale deed and petitioner and others participated in the

Patna High Court Cr.Misc. No.68538 of 2018(2) dt.13-12-2018 2/2 aforesaid transaction.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Saran, Chapra in Janta Bazar P.S. Case No. 12 of 2017, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
