The petitioner is in custody in connection with Kuchaykote P.S. Case No. 383 of 2018, registered for the offence punishable under Sections 30 (a) (b) (c)/38/41 (a) (b) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that petitioner is driver of the seized vehicle. Learned counsel for the petitioner next contended that petitioner is in custody since 23.12.2018 in connection with seizure of 3771.360 liters of foreign liquor from the truck.
Considering the fact that the petitioner has no criminal

No.19727 of 2019(2) dt.01-04-2019 2/2 antecedent and petitioner is driver of the vehicle from which alleged wine was recovered and he has remained in custody for more than three months, the Court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.D.J. IInd cum Special Judge, Excise Act, Gopalganj in connection with Kuchaykote P.S. Case No. 383 of 2018.
