The petitioner seeks regular bail in connection with Government Official Comp, Excise Case No. 2 of 2017 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 105 litres of illicit spirit from the agricultural land of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 28.09.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.76805 of 2018(2) dt.11-01-2019 2/2 case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran, Motihari in connection with Government Official Comp, Excise Case No. 2 of 2017.
