2. A supplementary affidavit has been filed by the learned counsel for the petitioner and the same is taken on record.

3. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 24.07.2024 passed in Cr. Misc. No. 49316 of 2024 .

4. The petitioner seeks regular bail in a case registered for the offence under Sections 195, 197, 412 of the Indian Penal Code and under Sections 25(1-b)a, 27 and 35 of the Arms Act.

5. Out of 13 witnesses, four witnesses have been examined. The petitioner is in custody since 22.06.2024. It

Patna High Court CR. MISC. No.20426 of 2025(3) dt.11-07-2025 2/2 appears that for a trivial dispute, the deceased was assaulted by the accused persons including this petitioner outside a mall. The accused persons are not said to have used any weapon. Similarly, situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 64136 of 2024 dated 11.12.2024.

6. Considering the fact that the deceased was assaulted on the spur of the moment for a trivial dispute by the accused persons and they did not use any weapon to assault the deceased and also considering the period of custody of the petitioner, the application is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Darbhanga/concerned Court below in connection with Kotwali P.S. Case No. 19 of 2024.
