Mr.Satya Nand Shukla ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-04-2023 The present petition has been filed for modification of the order dated 14.03.2023 passed in Cr. Misc. No. 69640 of 2022.

It is submitted by learned counsel for the petitioner that Cr. Misc. No. 69640 of 2022 was filed on 09.11.2022 and at the time of filing the petition, the petitioner had no criminal antecedent. Hence, in para 3 of the petition, it was mentioned that petitioner has got no criminal antecedent and the said fact was recorded in para 4 of the order dated 14.03.2023.

It is further submitted that after filing of Cr.

Patna High Court CR. MISC. No.25945 of 2023(2) dt.19-04-2023 2/2 Misc. No. 69640 of 2022, petitioner was remanded on 24.11.2022 in Kalyanpur P.S. Case No. 225 of 2022. The said fact could not be mentioned while the order was being passed since counsel for the petitioner had got no information in this regard from his client. On the ground mentioned in the modification petition, the same is allowed. Let para 4 of the order be read to have been passed that petitioner is accused in one other case apart from the present one.

The order dated 14.03.2023 passed in Cr. Misc. No. 69640 of 2022 is modified to the extent as indicated above.

Accordingly, the petition stands allowed.
