The petitioner apprehends his arrest in a case registered under section 302 and other allied sections of the Indian Penal Code and under different Sections of the Arms Act. The petitioner along with other accused persons having armed with different weapons went to the house of the informant and abused. Mritunjay Singh, Lalit Singh, Shankar Singh and Sonu Singh made indiscriminate firing. Lalit Singh fired which hit Komal Kumari, daughter of the informant and she died.

It is submitted that there is no specific allegation against the petitioner but from perusal of the F.I.R. it appears that the petitioner also accompanied other accused persons to the house

Patna High Court Cr.Misc. No.49384 of 2014 (2) dt.09-04-2015 of the informant where indiscriminate firing was made and the daughter of the informant died after having received fire arm injury.

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner in connection with Bhagwanpur P.S. Case No. 95/2014 pending in the court of the Chief Judicial Magistrate, Begusarai. This application is accordingly rejected.
