JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioner is apprehending her arrest in connection with Kamtaul P.S. Case No. 96 of 2016 registered for offences punishable under sections 302, 304(B)/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the case has been lodged under sections 302, 304(B)/34 of the Indian Penal Code. The allegation itself shows that the marriage was solemnized about 7-8 years ago.

As per the F.I.R., the petitioner, who is mother-inlaw of the deceased, was accompanied the deceased while she was taken to Hospital, as after the death of the deceased, the petitioner fled away, the present case has been filed only on the basis of suspicion and no case is made out under sections 302,

Patna High Court Cr.Misc. No.9871 of 2017 (2) dt.06-03-2017 2/2 304(B)/34 of the Indian Penal Code.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that the petitioner is mother-in-law and even according to the F.I.R., she was accompanied the deceased for her treatment, but she died in the way and as such, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Kamtaul P.S. Case No. 96 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
