The petitioner apprehends his arrest in connection with Nagar P.S. Case No.314 of 2015 registered under Section 409 of the Indian Penal Code, pending in the court of the C.J.M. Begusarai.
The accusation is that the petitioner was working as Rural Revenue Franchisee for collection of Electric Bill in Rural Area. While the petitioner collected Rs.3,00,000/- from the consumers but did not deposit the same to the North Bihar Power Distribution Company.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.43549 of 2015 (2) dt.15-10-2015 2/2 submits that, in fact, Rs.14,00,000-15,00,000/- of the petitioner was due against the concerned department.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within six weeks from today and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
