The petitioner being the S.D.O. of North Bihar Power Distribution Corporation Limited is apprehending his arrest in a case registered for the offences punishable under Sections 285, 304/34 of the Indian Penal Code. The prosecution case is that the husband of the informant being electrician was called by the petitioner through co-accused Mumtaz for doing some electric repairing work. Subsequently, it is alleged that the husband of the informant fell down from the pole due to electric shock and died on the spot.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.42888 of 2015 (2) dt.15-10-2015 petitioner that there is noting on record to show that the husband of the informant was an employee of the Electric Supply Distribution Company. It appears that he was doing some repair work of his own, when he got electrocuted. The Electric Supply and Distribution Company tried to save him and provide medical assistance. There is nothing on record to suggest that the husband of the informant was asked by the petitioner for doing electrical repair work.

Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Mufassil P.S. Case No. 106 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
