The petitioner seeks bail in Barachatti P.S. Case No. 345/16 registered under Sections 272, 273, 120(B) of the Indian Penal Code and Sections 47(a), 48(2), 54 and 63 of the Bihar Excise (Amendment) Act, 2016.
It has been submitted on behalf of the petitioner that though it is alleged that there is a recovery of 50.25 litres of English wine from the possession of the petitioner but, as a matter of fact, three vehicles were intercepted and from two vehicles illicit liquor was recovered and the petitioner was asked to put his signature on the seizure list but he refused and, therefore, he has been implicated in the case and he is in jail for about three months. Heard learned A.P.P. also.

No.54630 of 2016 (3) dt.09-01-2017 2/2 Having heard both sides and in view of the fact that the petitioner is in custody for about three months and there is no criminal antecedent against the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati (Gaya) in Barachatti P.S. Case No. 345/16.
