JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioners and the State. The petitioners being the brother's wife of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 498A, 302 and 201/34 of the Indian Penal Code.
The accusation is of killing the sister of the informant after 8 years of the marriage by causing burnt injury. It is submitted by learned counsel for the petitioners that the husband of the victim and husband of the petitioners have been acquitted vide judgment dated 01.06.2015 passed by learned 8th Adhoc Addl. Sessions Judge, Bhojpur, Ara in Sessions Trial No. 36 of 2015.
Considering the fact that the co-accused including the husband of the victim have been acquitted and the petitioners
Patna High Court Cr.Misc. No.44892 of 2015 (2) dt.22-09-2015 2/2 being ladies, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 91 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
