The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,325 and 379/34 of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case is that the petitioner assaulted the informant by the butt of rifle and took away eighteen thousand rupees from the petroleum dealership of the informant. It is submitted by the learned counsel for the petitioner that for the occurrence of 1.8.2015 at 2.30 A.M. the FIR was registered on the same day at 8.05 A.M. There is counter version of the occurrence also and Statement has been made in

Patna High Court Cr.Misc. No.41732 of 2015 (2) dt.09-10-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the accusation has been levelled since the petitioner protested for selling oil on higher price.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Piri Bazar P.S. Case No. 47 of 2015 pending in the court of learned SDJM, Lakhisarai. This application is disposed of with the aforesaid observation/direction.
