ANJANA PRAKASH ORAL JUDGMENT Date: 07-07-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 28.4.2009 by which the Chief Judicial Magistrate, Begusarai, has transferred the case to the court of Judicial Magistrate, 1st Class, Begusarai and charge sheet was submitted in Ballia P.S. Case No. 59 of 2007 against the Petitioner.

It has been submitted that without taking cognizance the case was transferred to the said Court, It may be an irregularity but, since this Court is not aware as to what transpired after the impugned order was passed, the application is disposed off with a direction to the Court below to pass an appropriate order in regard to the Proceeding against the Petitioner

Patna High Court Cr.Misc. No.10795 of 2013 dt.07-07-2015 2/2 in the manner it deems fit within a period of three weeks from the date of receipt of this order.
