====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2018 Heard Sri Manoj Kumar, learned counsel for the petitioner and Sri Madan Kumar, learned Additional Public Prosecutor.

The sole petitioner who is in custody since 21.06.2018 in connection with Nawada (Bundelkhand ) P.S. Case No. 183 of 2018 registered for the offence under Sections 363/ 365/ 341/ 323/498(A) / 34 of the Indian Penal Code, 1860 [ hereinafter referred to as the "I.P.C."] has prayed for grant of bail Learned counsel for the petitioner submits that it is true that petitioner is husband of the informant but in an another dispute colour has been given as if due to nonfulfillment of demand of dowry the informant was tortured. In respect of provision contained in Sections 363, 365, 341, 323,

It has been argued that it is a peculiar case in which the informant has alleged as if the petitioner has forcibly taken away the children. He submits that petitioner being father of children is entitled to keep them with him. Be that as it may, considering the nature of accusation as well as period of custody, let the petitioner / Harun Chaudhary @ Arun Chaudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada / concerned court in connection with Nawada ( Bundelkhand ) P.S. Case No. 183 of 2018 .
