Public Prosecutor for the State and also heard learned counsel for the informant.
Petitioner seeks bail in a case registered under section 302 and other minor sections of the Indian Penal Code and 27 of the Arms Act.
Present occurrence appears to have taken place on account of accumulation of soil and it is alleged that the petitioner opened fire on the informant but firing of the petitioner did not hit the informant and in the meantime, co- accused Fantush Kumar shot fire at the son of the informant who was declared brought dead by the concerned doctor.
Learned counsel appearing for the informant points out that earlier petitioner filed anticipatory bail which was disposed of by a coordinate bench of this court vide order dated 19.1.2016 passed in Cr. Misc. no. 3030/2016 giving liberty to the petitioner to surrender
Patna High Court Cr.Misc. No.39067 of 2016 (2) dt.21-09-2016 within a period of six weeks but the petitioner fled to Gujrat from where he was arrested and got remanded in this case. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Muffasil (Nawada) P.S. Case no. 208/2015.
