The petitioner seeks bail in a case instituted for the offences under Section 25A of the Arms Act.
The prosecution case in short is that a country made pistol with one bullet was recovered from the possession the accused person.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.2.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. It is a case of misuse of bail. The informant was examined during the trial. The deposition of the informant is Annexure-P/2 to the present application. As per his
Patna High Court CR. MISC. No.24551 of 2019(3) dt.24-04-2019 2/2 deposition, the matter was compromised between the parties. Under the said impression, proper pairvi was not made on behalf of this petitioner before the Court below. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. V, Danapur, Patna in connection with Bihta P.S. Case No. 157 of 1986.
