The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Excise Act, 2016.
It is a case of recovery of English made wine from Ashok Leyland Container.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that no incriminating wine was recovered from the conscious possession of the petitioner and petitioner has not been apprehended at the spot. Petitioner has got clean antecedent.
Learned APP appearing for the State opposed the
Patna High Court CR. MISC. No.22090 of 2022(2) dt.26-08-2022 2/2 anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Special Judge, Excise Act, Jehanabad in connection with Arwal P.S. Case No. 158 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
