JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 485 (C) /2013 for the offence under Sections 498(A)/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution case, in brief, is that the complainant was married with the petitioner on 25.04.2006 and went to her sasural where soon after her arrival her mother-in-law made complaint that her son was not given gold chain at the time of ' Khir- Khilal' and gave threatening to be driven out from the house if the motor cycle, cash of Rs. 50,000/- and Rs. 50,000/ gold chain was not given. After about one month, the petitioner and his maternal

Patna High Court Cr.Misc. No.49749 of 2014 (2) dt.30-04-2015 2/3 uncle-in-law came and told that if the demand was not fulfilled they would not keep the complainant with them. It is further alleged that they often used to come to the paternal house of the complainant and used to abuse and assaulted her and in the meantime the complainant gave birth to a female child. Learned counsel for the petitioner submitted that the petitioner has no criminal antecedent. It is further submitted that the petitioner has falsely been implicated in this case. .The petitioner has filed a Matrimonial Suit under Section 9 of the Hindu Marriage Act but the complainant did not want to reside with the petitioner.

On behalf of the State, it is submitted that the petitioner is the husband of the complainant and there is specific allegation against the petitioner.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Munger in connection with Complaint Case No. 485C/2013, subject to the conditions, as laid down u/s 438(2) Cr.P.C. with an additional condition that the petitioner shall deposit an amount of Rs. 2500/-

Patna High Court Cr.Misc. No.49749 of 2014 (2) dt.30-04-2015 3/3 (twenty five hundred ) per month in the court below , which shall be released in favour of the complainant.
