2. The petitioners apprehend their arrest in a case registered for the offence under Sections 420, 379 / 34 of the Indian Penal Code.
3. Petitioners are owner of Tractor, bearing Tractor Nos. BR01GL-0773 and BR01GH-5693 respectively, which were seized by the Mines Department, Patna due to overloading of sand.
4. It is submitted on behalf of petitioners that petitioners have been made accused merely because they happen to be owner of the tractors in question. It is further submitted
Patna High Court CR. MISC. No.24529 of 2024(2) dt.24-04-2024 2/2 that the fine, imposed by the Mines Department, Patna, has already been deposited by these petitioners. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur (Patna) in connection with Shahpur P.S. Case No. 778 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
