JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.
The prosecution case as per the fardbeyan is that on 06.06.2014 the informant got information that some miscreants have committed theft of construction material which were kept in the Ara-Chapra under construction Ganga Bridge. One tractor was found loaded with construction materials. The petitioner is driver of the tractor. It is submitted by learned counsel for the petitioner that for a dispute with regard to carrying charges the accusation has been levelled when the owner of the tractor has been granted anticipatory bail vide Cr. Misc. No. 7556 of 2015. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.41944 of 2015 (2) dt.12-10-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Barhara P.S. Case No. 110 of 2014, pending in the Court of learned Chief Judicial Magistrate, Bhojpur at Ara. With the observations above, the application stands disposed off.
