This application for anticipatory bail arises out of Bibhutipur P.S. Case No.209 of 2018, disclosing offences under Sections 420,467,468,471 of the Indian Penal Code. The petitioner is said to have obtained employment as panchayat teacher on the basis of documents, which were subsequently found to be forged.

Learned Senior counsel appearing on behalf of the petitioner has contended that service of the petitioner has since been terminated and since the allegation against the petitioner is based on document, there is no chance of tampering with the evidence. I find force in the submission so

Patna High Court Cr.Misc. No.76800 of 2018(2) dt.09-01-2019 2/2 advanced on behalf of the petitioner. This application is allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Rosera, Samastipur in Bibhutipur P.S. Case No.209 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
