ANJANA PRAKASH ORAL JUDGMENT Date: 07-07-2015 The Petitioner seeks revision of the order dated 28.9.2013, by which the Principal Judge, Family Court, Jamui in Maintenance case No.35M of 2011 directed him to pay Rs.8000/- per month to the Opposite Party No.2 from the date of the order and Rs.5000/- per month as arrears of maintenance from the date of filing of maintenance case i.e. Rs.13,000/- per month through salary of the Petitioner.
It has been submitted that the Petitioner gets salary of only Rs.15400/-.
In such circumstances, the amount is flatly reduced to Rs.5000/- per month, which the Petitioner shall pay to the Opposite
Patna High Court CR. REV. No.1250 of 2013 dt.07-07-2015 2/2 Party No.2 from the date of the order. The court below shall calculate the arrears at this rate within a period of four weeks from the date of receipt of this order, upon which the Petitioner shall make payments on instalments to be fixed by the Principal Judge Family Court, Jamui considering the financial status of the Petitioner and the Opposite Party No.2.
With the aforesaid observations, the application stands disposed of.
