JUSTICE SANJAY PRIYA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ghorasahan P.S. Case No. 435/16 instituted for the offence under Section 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition of Excise Act, 2016. It is alleged that 149 bottles Nepali Saufi wine, each containing 300 ml. has been recovered from the hut of this petitioner. It is alleged that this petitioner managed to run away on seeing police party. Seizure list was prepared after recovery of aforesaid liquor from the hut. In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

The petitioner may surrender before the court below and pray for regular bail.
