The petitioner is apprehending his arrest in connection with Ara Muffasil P.S.Case No. 223 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though originally the case has been lodged under Section 302 and other sections of the Indian Penal Code but later on it was converted into Section 306 of the Indian Penal Code. It has further been submitted that from the materials collected during course of investigation it has come that there was hot exchange of words between the petitioner and the deceased and thereafter the petitioner left for the market and in the meantime the deceased committed suicide by setting herself on fire. It has further been submitted that it has come in paragraphs 9, 10, 13 and 14 of the case diary that some altercation took place between the petitioner

Patna High Court Cr.Misc. No.52045 of 2016 (3) dt.28-01-2017 2/2 and the deceased, which is evident from the impugned order. Heard learned APP also.

Having heard both sides and in view of the materials available in the case diary, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara, in connection with Muffasil P.S.Case No. 223 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioner will co-operate in the investigation and make himself available before the police/court, as the case may be, as and when required, and in the event of failure on his part to appear before the court on two consecutive dates, his bail bond shall be liable to be cancelled.
