JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-06-2020 Heard Mr. Ratneshwar Prasad, learned counsel for the petitioner and Learned APP for the State. The petitioner, who is in custody since 23.01.2020, seeks bail in connection with Motipur P. S. Case No. 224 of 2019 dated 13.05.2019 instituted for offences under Sections 30 (a), 38(1) and 41 (1) of the Bihar Prohibition and Excise Amendment Act, 2018.
It appears from the prosecution report that 60 litres of liquor was recovered from the bamboo orchard belonging to the petitioner.
The learned counsel for the petitioner has submitted that he has been falsely implicated in this case.
Patna High Court CR. MISC. No.20371 of 2020(2) dt.19-06-2020 2/2 The recovery is from an open place which is accessible to all and sundry.
Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Motipur P. S. Case No. 224 of 2019.
The petition stands allowed.
