The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 308, 323, 341, 324, 506, 504 of the Indian Penal Code.

Allegation petitioners is that they assaulted the informant with axe and hammer on his head.

It is submitted that both parties are own Gotias. There is case and counter case. Petitioner nos. 1 and 2 are own brothers of informant whereas, petitioner no. 3 is Bhabhi. Petitioners have been falsely implicated in this case due to

Patna High Court CR. MISC. No.24008 of 2023(2) dt.27-06-2023 2/2 dispute over partition of ancestral house. Petitioners claim clean antecedents.

Counsel for the informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Bhagalpur in connection with Kotwali (Barari) P.S.
