The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 417 and 418 of the Indian Penal Code.
Petitioner is full brother of the informant. Allegation is that he received back the gold which was kept with the U.A.E. Exchange for loan. The gold was deposited by the informant.
Learned counsel for the petitioner has drawn attention of the Court towards earlier settlement between the parties, which reveals that gold loan was to be paid by the petitioner and he was to receive back the gold. The earlier settlement is part of FIR.
Considering the aforesaid fact, let the petitioner,
Patna High Court CR. MISC. No.20297 of 2019(2) dt.02-04-2019 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Chapra Town Police Station Case No. 178 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
