2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Gopalganj P.S. Case No. 674 of 2025 instituted for the offence punishable under Sections 318(4), 316(2), 316(5) and 3(5) of BNS.

3. The case of the prosecution is that the petitioner who is a salesman of ITC has given commodities of ITC and HUL to the shopkeepers and has taken Rs. 9,10,998/- from the shopkeepers but the same has not been deposited in the company.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that all the allegations are frivolous as the petitioner has left the company, this case has been filed against

Patna High Court CR. MISC. No.25262 of 2026(2) dt.23-06-2026 2/2 him to malice him. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

5. Learned APP for the State and learned counsel for the informant have opposed the prayer for bail of the petitioner and have submitted that there is direct allegation against this petitioner of misappropriating Rs. 9,10,998/- of the company.

6. Having heard learned counsel for the parties and considering the nature of allegation, this Court is not inclined to grant anticipatory bail to the petitioner and, as such, his application for bail is rejected.

7. This application stands dismissed.
