The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

It is a case of recovery of about 145.230 liters of illicit liquor from the room which as alleged possessed by this petitioner.

It is submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has got clean antecedent. However, learned APP for the State has opposed the prayer for anticipatory bail of this petitioner. After considering the facts and circumstances and fact

Patna High Court CR. MISC. No.32974 of 2021(4) dt.11-04-2022 2/2 that the liquor was recovered from the room of the petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.

However, petitioner is directed to surrender before the court below and pray for regular bail.
