JUSTICE SATYAVRAT VERMA ORAL ORDER 26-11-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection Excise Complaint Case no. 54 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise (Amendment) Act. Learned counsel for the petitioner submits that the petitioner is in custody since 22.02.2021 and is person with clean antecedent and charge sheet has been submitted. No.31182 of 2021(2) dt.26-11-2021 2/2 of the allegation as alleged in the FIR, it would manifest that it is alleged that 155.520 liter country made liquor was recovered from a Swift car and apprehend accused disclosed the name of this petitioner. Further, petitioner is driver of the car and not owner as such was not aware of the content being carried in the car.

Learned APP opposed the prayer for bail.

Considering the facts that petitioner is in jail custody since 22.02.2021 and is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge (Excise), Gopalganj in Excise Complaint Case no. 54 of 2021.
