JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. On the information that the grains from the State Food Corporation godown was being transported, the raid was laid when a Pick-up van was intercepted loaded with 107 bags of rice each containing 50 Kgs., total 53.50 quintals. The driver of the Pick-up van suggested the name of the petitioner. Subsequently, the petitioner arrived on the spot and offered illegal gratification to the informant.

It is submitted by the learned counsel for the petitioner that the petitioner is neither PDS dealer nor the petitioner claimed either vehicle or the rice. Statement to that effect has been made in paragraph 8 of the petition which reads as follows:

Patna High Court Cr.Misc. No.41812 of 2015 (2) dt.12-10-2015 2/2 "That as a matter of facts, the petitioner has no concern either with the seized pick-up van or the rice loaded on the same." Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Saran at Chapra in connection with Parsa P.S. Case No.91 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
