====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2018 Heard Sri Rajib Ranjan Jha, learned counsel for the petitioner and Sr Mukeshwar Dayal, learned Additional Public Prosecutor.

The sole petitioner who is in custody since 06.07.2018 has prayed for grant of bail in connection with Banka P.S. Case No. 208 of 2018 registered for the offence under Sections 363/ 365 of the Indian Penal Code , 1860.

It was submitted by learned counsel for the petitioner that petitioner was not named in the F.I.R. and during investigation he has been arrayed as accused. Learned counsel for the petitioner has further argued that petitioner and informant resides in the same village however place of occurrence in the case was at a different place. On aforesaid grounds a prayer has been made for granting bail.

Patna High Court Cr.Misc. No.69411 of 2018(2) dt.30-11-2018 2/2 Sri Dayal, learned Additional Public Prosecutor by way referring to the statement made in paragraph 7 of the petition submits that petitioner himself has stated that during investigation name of petitioner has surfaced in which it was alleged that petitioner had demanded Rs. 8,000/- for returning the victim girl who was aged about three years. In view of the facts and circumstances particularly the nature of accusation there is no reason to pass favourable order.
