Petitioner seeks bail in Sugauli P.S. Case No.242 of 2019 registered under Sections 272, 273 and 34 of the I.P.C. and under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the prayer for anticipatory bail of the petitioner was earlier rejected. The name of the petitioner surfaced in the case on the basis of confession made by the driver of the vehicle from whose possession 279.04 litres of Indian made foreign liquor was recovered. The petitioner was remanded in this case from Harsidhi P.S. Case No.337 of 2019. The petitioner is in jail since 06.03.2020.

Having considered the facts that the name of the petitioner surfaced in the case in the confessional statement of

No.19946 of 2020(2) dt.26-06-2020 2/2 the driver from whose possession 279.04 litres of Indian made foreign liquor was recovered and the petitioner is in jail since 06.03.2020, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 9th Additional Sessions Judge-cumSpecial Judge, Excise, East Champaran, Motihari in connection with Sugauli P.S. Case No.242 of 2019.
