The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 32(ii) of the Bihar Prohibition Excise Act.

It is a case of recovery of foreign liquor brought by a truck.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor or seized vehicle and not apprehended at the spot and the name of the petitioner was disclosed by apprehended co-accused. Petitioner has three criminal antecedents.

Patna High Court CR. MISC. No.22079 of 2022(2) dt.15-09-2022 2/2 Learned APP appearing for the State opposed the anticipatory bail.

Accordingly, this application is disposed of with a direction to the petitioner to surrender before the court below and pray for regular and the court below may consider his prayer for bail after hearing the submission of learned counsel for the petitioner.
